Delta-9 THC is illegal beyond a .03% basis by dry weight — meaning the total weight of THC within a product must be under the limit. When dealing with hemp flower, the low weight of the flower makes this too restrictive to feel an intoxicating effect.
However, the added weight of a gummy gives producers more room to work with. .03% of the total weight of a gummy might allow for 50mg or more of THC. This far exceeds an active dose which starts for most at around 10mg.
How is Hemp-Derived Delta-9 THC Different from Weed?
In terms of activity and structure, there is likely no difference between delta-9 THC from hemp and weed. The real differences come down to the need for production and the lack of regulation in the hemp industry.
While the molecule is the same, hemp companies have very few regulations on the products they create. The only reporting a hemp product actually must get by law is to report on the levels of delta-9 THC on a percentage basis.
This means reporting may not look for things like residual chemicals, pesticides, or other concerns. Due to this fact, it’s important to make sure you are properly vetting your cannabis vendors to ensure the contents of the package match what’s on the label.
Delta-9 THC Vs. Delta-8 THC
On a molecular level, the only difference between delta-8 and delta-9 THC is the location of a double bond — on the 8th or the 9th carbon, respectively. While this is a minor difference in the structure of the cannabinoid, it does result in slightly different effects.
Namely, delta-8 THC is roughly ⅔ as potent as delta-9 THC by most subjective reports. While the trend in cannabis is often toward seeking higher potencies of THC, there’s a lot to be said for a product that’s not as intoxicating.
This is true both for people who are particularly sensitive to THC and for those who want to benefit from THC without feeling overwhelmed by it.
